Terms of Service

These Terms of Service govern your use of the Monitor.CAT WordPress plugin and the monitor.cat website. By installing the plugin or using the website, you agree to be bound by these Terms.

1. Plugin Scope

The Monitor.CAT plugin (the "Plugin") is a self-contained WordPress toolkit providing SEO analysis, speed optimization, and system diagnostics. The Plugin runs entirely on your WordPress installation — no external services, accounts, or data transmission are involved. The features and functionality of the Plugin may be modified, extended, or discontinued over time.

2. Eligibility and Authority

By installing the Plugin or accepting these Terms, you represent and warrant that: (a) you are of legal age to form a binding contract; (b) you are duly authorized to install plugins and accept these Terms on behalf of the site owner or the organization that owns or controls the WordPress installation; and (c) your use of the Plugin complies with all applicable laws and regulations.

3. Installation and Usage Responsibility

You are solely responsible for: (a) maintaining control of administrator accounts associated with your WordPress installation; (b) reviewing and configuring Plugin settings, including which speed optimizations are active; and (c) ensuring the Plugin is compatible with your hosting environment, theme, and other installed plugins. The Plugin modifies frontend output and database content as part of its normal optimization operations.

4. Acceptable Use

You agree not to use the Plugin to: (a) engage in any activity that is unlawful, abusive, fraudulent, or malicious; (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Plugin beyond what is permitted by the GPL license; (c) redistribute modified versions of the Plugin under the Monitor.CAT name without prior written consent; or (d) misrepresent the Plugin's functionality or authorship.

5. Data Processing

The Plugin processes all data locally on your WordPress installation. No data is transmitted to external servers. The Plugin analyzes page content, server configuration, and database statistics to provide its SEO, speed, and diagnostic features. All processed data remains within your WordPress database and is removed upon uninstall.

6. Speed Optimization Features

Speed optimization features — including but not limited to script deferral, head cleanup, lazy loading, heartbeat reduction, and database cleanup — modify your site's frontend output and database content. These optimizations run automatically when enabled. You are responsible for reviewing active optimizations and disabling any that conflict with your theme or other plugins. Monitor.CAT shall not be liable for display issues or functionality changes caused by enabled optimizations.

7. Plugin Availability and Changes

The Plugin is provided as open-source software under the GPL-2.0-or-later license. We reserve the right to modify, improve, or discontinue any feature of the Plugin, with or without prior notice, provided that we will endeavor to give reasonable advance notice of material changes where practicable.

8. Security and Incident Response

We apply reasonable technical security safeguards in the development of the Plugin. If you discover a security vulnerability, please report it privately at [email protected]. We will make reasonable efforts to respond to security reports in a timely manner.

9. Disclaimer of Warranties

THE PLUGIN IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES WITH RESPECT TO THE PLUGIN.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONITOR.CAT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLUGIN, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Termination

You may terminate your use of the Plugin at any time by deactivating and uninstalling it. Upon uninstall, all Plugin data is removed from your WordPress database through the standard WordPress uninstall process.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with Hungarian law, unless mandatory local law requires otherwise. Any dispute arising out of or relating to these Terms or the Plugin shall be resolved through good-faith negotiation in the first instance. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the competent courts of Budapest, Hungary, except where prohibited by applicable law.
