Terms of Service

These Terms of Service govern your use of the Monitor.CAT WordPress connector plugin and the Monitor.CAT service. By installing the plugin or using the service, you agree to be bound by these Terms.

1. Service Scope

The Monitor.CAT connector plugin (the "Plugin") connects your WordPress site to the Monitor.CAT platform (the "Service") for the purpose of monitoring, diagnostics, security and single sign-on (SSO) related workflows, and authorized remote management operations. The features and functionality of the Service may be modified, extended, or discontinued over time.

2. Eligibility and Authority

By installing the Plugin or accepting these Terms, you represent and warrant that: (a) you are of legal age to form a binding contract; (b) you are duly authorized to install plugins, establish connections, and accept these Terms on behalf of the site owner or the organization that owns or controls the WordPress installation; and (c) your use of the Service complies with all applicable laws and regulations.

3. Account and Connection Responsibility

You are solely responsible for: (a) maintaining control of administrator accounts and all connection credentials associated with your WordPress installation; (b) safeguarding bearer tokens, pairing codes, API keys, and other secrets generated or used by the Plugin; and (c) promptly disabling or disconnecting the integration if unauthorized access or use is suspected. You agree to notify us immediately at [email protected] upon becoming aware of any actual or suspected unauthorized use.

4. Acceptable Use

You agree not to use the Plugin or Service to: (a) engage in any activity that is unlawful, abusive, fraudulent, or malicious; (b) attempt to gain unauthorized access to Monitor.CAT systems, servers, networks, or third-party systems through or in connection with the Service; (c) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service; (d) interfere with, disrupt, or impose an unreasonable burden on the Service infrastructure or its underlying systems; or (e) resell, sublicense, or otherwise commercialize access to the Service without our prior written consent.

5. Data Processing

By completing the Plugin setup and pairing process, you authorize the transmission of technical site metadata to Monitor.CAT that is required for service operation. The categories of data collected and the purposes for which they are processed are described in detail in the Privacy Policy, available at monitor.cat/privacy. To the extent that such processing involves personal data subject to the EU General Data Protection Regulation (GDPR) or equivalent legislation, the Privacy Policy constitutes the applicable data processing notice.

6. Remote Management Features

Remote management features — including but not limited to remote plugin installation, activation, deactivation, and theme management workflows — are executed only when (a) explicitly enabled by an authorized administrator of the WordPress installation and (b) properly authorized through the applicable authentication mechanisms. You are solely responsible for reviewing, enabling, and controlling which remote actions are authorized within your environment. Monitor.CAT shall not be liable for actions taken as a result of remote management features that were authorized through your credentials.

7. Service Availability and Changes

The Service is provided on a commercially reasonable basis. We do not warrant uninterrupted or error-free operation of the Service. We reserve the right to modify, improve, suspend, or discontinue any feature or the Service as a whole, with or without prior notice, provided that we will endeavor to give reasonable advance notice of material changes where practicable.

8. Security and Incident Response

We apply reasonable technical and organizational security safeguards in the operation of the Service. If you believe that your integration has been compromised, you must contact us immediately at [email protected]. We will make reasonable efforts to respond to security incidents in a timely manner.

9. Disclaimer of Warranties

THE PLUGIN AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES WITH RESPECT TO THE PLUGIN AND THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONITOR.CAT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLUGIN OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS PAID BY YOU, IF ANY, TO MONITOR.CAT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

You may terminate your use of the Service at any time by disconnecting or uninstalling the Plugin. We reserve the right to suspend or terminate your access to the Service, with or without notice, for reasons including but not limited to: a security incident, violation of these Terms, abuse of the Service, legal requirements, or operational necessity. Upon termination, your right to use the Service ceases immediately; data deletion is handled in accordance with the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the applicable law of the jurisdiction in which Monitor.CAT operates, unless mandatory local law requires otherwise. Any dispute arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation in the first instance. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the competent courts of Monitor.CAT's jurisdiction, except where prohibited by applicable law.
